الوَصِيَّةُ


THE Will




الوَصِيَّةُ / The Will

1ـ رسولُ اللهِ‏ِ (صَلَّيَ اللهُ عَلَيهِ وَ آلِهِ): الوَصِيَّةُ حَقٌّ على كُلِّ مُسلمٍ.
1– The Prophet (SAWA) said, ‘The will is incumbent upon every Muslim.’
[Wasael al-Shi`aah , v. 13, p. 352, no. 6]

2ـ رسولُ اللهِ (صَلَّيَ اللهُ عَلَيهِ وَ آلِهِ): المَحرومُ مَن حُرِمَ الوَصيَّةَ.
2– The Prophet (SAWA) said, ‘The deprived one is he who has been deprived of
[the opportunity to write] a will.’

3ـ رسولُ اللهِ (صَلَّيَ اللهُ عَلَيهِ وَ آلِهِ): ما يَنبَغي لامرئٍ مُسلمٍ أن يَبِيتَ لَيلَةً إلّا ووَصيَّتُهُ تَحتَ رأسِهِ.
3– The Prophet (SAWA) said, ‘A muslim must not sleep a night without his will being beneath his head.’

4ـ الإمامُ الباقرُ (عَلَيهِ الّسَلامُ): مَن لَم يُوصِ عِندَ مَوتِهِ لِذَوي قَرابَتِهِ مِمَّن لا يَرِثُهُ فَقد خَتَمَ عَمَلَهُ بمَعصِيَةٍ .
4– Imam al-Baqir (AS) said, ‘Whoever does not leave a will for those of his family who do not automatically inherit him, his deeds end in disobedience
[to Allah].’

الإضرارُ وَالحَيفُ فِي الوَصِيَّةِ / The Damages and Injury Payable from One’s Will

5ـ الإمامُ عليٌّ (عَلَيهِ الّسَلامُ): مَن أوصى ولَم يَحِفْ ولَم يُضارَّ كانَ كَمَن تَصَدَّقَ بهِ في حَياتِهِ .
5– Imam Ali (AS) said, ‘He who bequeaths wealth and does not leave any injury or damages to be paid thereof is as though he gave it in charity during his lifetime.’

6ـ الإمامُ عليٌّ (عَلَيهِ الّسَلامُ): الحَيفُ في الوَصيَّةِ مِن الكَبائرِ.
6– Imam Ali (AS) said, ‘Leaving damages
[to be paid] in one’s will is among the grave sins.’
[al-Faqih, v. 4, p. 184, no. 5420]

7ـ الإمامُ الصّادقُ (عَلَيهِ الّسَلامُ): مَن أوصى بِالثُّلُثِ فَقَد أضَرَّ بِالوَرَثَةِ، والوَصيَّةُ بِالخُمسِ والرُّبعِ أفضَلُ مِن الوَصيَّةِ بِالثُّلُثِ، ومَن أوصى بِالثُّلُثِ فلَم يَترُكْ.
7– Imam al-Sadiq (AS) said, ‘He who bequeaths a whole third
[of his estate to pay for injury and damages] has wronged his heir, and leaving a bequest of a quarter or a fifth
[of one’s estate] is better than bequesting a third.’
