LIABILITY




الضَّمانُ / Liability

1. رسولُ اللّه صَلَّى اللهُ عَلَيه وَ آلِهِ: عَلَى اليَدِ ما أخَذَت حتّى تُؤَدِّيَهُ.
1. The Prophet (SAWA) said, ‘The hand is responsible for whatever it takes into its possession until it returns it to its rightful place.’

2. الإمامُ عليٌّ عَلَيهِ السَّلامُ: مَن تَطَبَّبَ أو تَبَيطَرَ فَلْيَأخُذِ البَراءةَ مِن وَلِيِّهِ، وإلاّ فهُو لَهُ ضامِنٌ.
2. Imam Ali (AS) said, ‘He who practices medicine or veterinary science must first insure himself against culpability from his client, otherwise he may be held liable.’

3. الإمامُ الصّادقُ عَلَيهِ السَّلامُ: مَنِ استُؤجِرَ على عَمَلٍ فَأفسَدَهُ واستَهلَكَهُ ضَمِنَ، وكانَ أميرُ المؤمنينَ عليه السلام يُضَمِّنُ الأجيرَ.
3. Imam al-Sadiq (AS) said, ‘Someone who is employed for a job, and spoils it and it ends up wasted is liable for it. The Commander of the Faithful Ali (AS) used to hold employees liable.’

4. الإمامُ الصّادقُ عَلَيهِ السَّلامُ: يَضْمَنُ الصُّنّاعُ ما أفسَدُوا، أخطَؤوا أو تَعَمَّدُوا إذا عَمِلُوا بأجرٍ.
4. Imam al-Sadiq (AS) said, ‘Workmen, when employed for a job, are liable for whatever they spoil, whether they do it by mistake or deliberately.’

ذَمُّ التَّعَرُّضِ للكفالَةِ والضَّمانِ / Reprehension of Risking Liability or Culpability

5. الإمامُ عليٌّ عَلَيهِ السَّلامُ: لا تَضمَنْ ما لا تَقِدرُ على الوَفاءِ بهِ.
5. Imam Ali (AS) said, ‘Do not give a guarantee for something that you are not able to fulfill.’
[Ghurar al-Hikam, no. 10187]

6. الإمامُ الصّادقُ عَلَيهِ السَّلامُ: الكَفالَةُ خَسارَةٌ، غَرامَةٌ، نَدامَةٌ.
6. Imam al-Sadiq (AS) said, ‘Liability is a loss, a penalty and a source of regret.’

لا ضَمانَ في العارِيَةِ / There is no Liability on Something Borrowed

7. الإمامُ الصّادقُ عَلَيهِ السَّلامُ: لا غُرمَ على مُستَعِيرِعارِيَةٍ إذا هَلَكَت إذا كانَ مَأمُونا.
7. Imam al-Sadiq (AS) said, ‘There is no penalty payable by someone who borrows something, which becomes spoilt while in his possession, if he is a trustworthy person.’
